Focus

The ‘Rule of Law’ is uncontestably a crucial issue in today’s constitutional systems. Its scope may be broad or narrow; its content may be thick or thin, liberal or illiberal; discourses may be rich or poor, consensual or controversial. In each case, a certain, more or less consistent or inconsistent understanding of this fundamental issue informs legal norms, academic scholarship and effective practice in a given country.
The focus of this research group is to carry out a comprehensive investigation on the rule of law traditions of as many ‘other’ countries in the world as possible. The aim is to have a broader outlook to the concept of rule of law in various countries, by restating the deeper cultural context and background (historical, intellectual, political, social) of this current settlement, in order to emphasize, especially from a historical and comparative perspective, what is special about the given country’s rule of law understanding and practice. In view of this target, among others, we hope to reveal potential cultural transfers from one of the ‘leading models’ (US, UK, Germany) or any other country and to what extent is the local rule of law understanding ‘home grown’ or nested in an intercultural/international dialogue.

Events

The purpose of this research group is to create a discussion forum on the rule of law traditions. Accordingly, we aim at organizing a conference or a workshop once a year and carry out publications.

We will hold the first workshop in the University of Luxembourg (Luxembourg) on November 28-29, 2019.
